Event participation waiver

Introduction

Clematis Paws organizes temporary, dog-friendly pop-up social experiences in West Palm Beach, Florida and nearby neighborhoods. Participation in any Clematis Paws event — including PARK(ing) Day activations, yappy hours, and related gatherings — involves inherent risks.

By registering for, attending, or participating in a Clematis Paws event, you acknowledge that you have read, understand, and agree to the terms of this Event Participation Waiver on behalf of yourself and, where applicable, any minor or dog under your care.

Eligibility and rules

Participants must follow all posted event rules, staff directions, and applicable local ordinances. Clematis Paws reserves the right to refuse entry or remove any participant — human or dog — whose behavior poses a safety concern or disrupts the experience for others.

• Dogs must remain under the control of a responsible adult at all times.
• Aggressive, excessively fearful, or visibly ill dogs may be asked to leave.
• Participants must comply with leash, vaccination, and licensing requirements posted for each event.
• Clematis Paws may modify event layout, capacity, or programming for weather, safety, or permitting reasons.

Assumption of risk

You understand and voluntarily assume all risks associated with attending an outdoor, dog-inclusive community event. These risks include, without limitation:

• interactions between dogs and other dogs, people, or objects;
• slips, trips, falls, or contact with uneven surfaces, curbs, equipment, or temporary structures;
• exposure to weather, heat, sun, insects, allergens, and environmental conditions;
• illness or injury arising from ordinary event activities;
• contact with food, water stations, toys, or shared amenities;
• the conduct of other participants, vendors, or third parties beyond Clematis Paws' reasonable control.

You accept these risks and choose to participate with that understanding.

Dog-owner responsibility

If you bring a dog to an event, you represent and agree that:

• you are the dog's owner or authorized handler with legal authority to accept these terms;
• your dog is current on vaccinations and free from contagious illness to the best of your knowledge;
• you will supervise your dog at all times and promptly clean up after your dog;
• you are solely responsible for your dog's behavior, damage, or injury caused by your dog;
• you will not bring a dog you know to be aggressive, reactive in unsafe ways, or unsuited to a social public setting.

Clematis Paws does not provide veterinary, training, or childcare services at events unless expressly stated in writing for a specific activation.

Release and indemnification

To the fullest extent permitted by Florida law, you release, waive, and discharge Clematis Paws, its organizers, volunteers, contractors, venue partners, sponsors, and respective officers, members, and representatives from any and all claims, demands, damages, losses, or causes of action arising out of or related to your participation in an event, including claims arising from ordinary negligence, except where such release is prohibited by law.

You agree to indemnify and hold harmless the released parties from any claim, liability, cost, or expense (including reasonable attorneys' fees) arising from your conduct, your dog's conduct, or your breach of this waiver.

Counsel should review the scope of release, indemnification, and any limitations under Florida law before this section is finalized.

Medical treatment

In the event of illness or injury, you authorize Clematis Paws staff or volunteers to obtain emergency medical assistance for you or, where permitted by law, for a minor or dog under your care. You accept financial responsibility for any medical or veterinary care obtained on your behalf, except to the extent covered by your own insurance or applicable law.

Photography notice

Clematis Paws events may be photographed and filmed for community storytelling and promotional use. Your attendance may appear in event media unless you follow the opt-out process described in our Photo and Media Release. That document governs the specific terms of media use and should be read together with this waiver.

General provisions

If any provision of this waiver is held invalid or unenforceable, the remaining provisions will continue in full force and effect. This waiver constitutes the entire agreement regarding event participation risk between you and Clematis Paws for the event attended and supersedes prior oral or written understandings on that subject.

This waiver is intended to be governed by the laws of the State of Florida, without regard to conflict-of-law principles, subject to review by qualified counsel.
